JUSTICE JITENDRA KUMAR ORAL ORDER 10-11-2025 Present writ petition has been preferred by the petitioner stating that she purchased a parcel of land bearing Khata No. 4, Khesra No. 162 situated at Mouza- Gangwara, measuring two katha, from one Jagannath Dubey in the year 1990.

2. It is further case of the petitioner that in pursuance of the sale deed, the parcel of land has been mutated in the name of the petitioner and when she attempted to raise a boundary wall on the land, local people obstructed in doing so and demanded rangdari.

3. Hence, petitioner is seeking police protection for raising such wall.

4. It is further case of the petitioner that one representation was made to Circle Officer, Darbhanga for demarcating her land as per the sale deed. However, no step has been taken by the Circle Officer.

5. It is also stated by the petitioner that she has no efficacious alternative remedy left with her, except to approach this Court.

6. However, learned AAG-12 for the State submits that attempt was made by the Circle Officer for measurement and demarcation, but when he reached the place, there was rival claim to title of the property and hence, he could not measure and demarcate the land of the petitioner.

In view of the aforesaid facts and circumstances, it appears that petitioner is not aware where her land is situated and it also appears that there are rival claims regarding title to the parcel of land which the petitioner is claiming to have purchased. In such situations, it would be better for the petitioner to move Civil Court for identification and possession of the land which she has purchased by the sale deed as she is claiming.

8. However, if the petitioner is sure regarding location of the land and the neighbours, she may approached the Revenue Court for measurement and demarcation of the land.

Accordingly, the present petition is disposed of with liberty to the petitioner to take step as observed above and if the petitioner moves any application before the Revenue Court, the Revenue Court would pass appropriate order within a reasonable time, preferably within two months. If the petitioner moves Civil Court, the Civil Court would also dispose of the suit as expeditiously as possible.
