JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Taraiya P.S. Case No. 294 of 2018 registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of minor daughter of the informant.

Submission of learned counsel for the petitioner is that statement of the victim girl has been recorded under Section 164 Cr.P.C. in which she disclosed her age as 18 years and she has not supported the prosecution case, rather has stated that she had gone on her own sweet will and she was found to be major in the medical examination, which has been stated in paragraph8 of the petition on oath. Heard learned APP also.

No.11914 of 2019(2) dt.27-02-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IX, Saran at Chapra, in connection with Taraiya P.S. Case No. 294 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
