The petitioner seeks bail in connection with Muzuffarpur Nagar P.S. Case No. 974 of 2021 instituted for the offences under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Excise & Prohibition (Amendment) Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 22.12.2021 and has antecedent of one case, charge-sheet has been submitted in the case and allegation is of recovery of 33 liters of liquor from the house of petitioner.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.9133 of 2022(2) dt.10-03-2022 2/2 house from which the liquor has been alleged to be recovered is a joint family property and as such petitioner is not knowing who had kept a liquor in the house.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 22.12.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Muzuffarpur in connection with Town P.S.
