JUSTICE VIKASH JAIN ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 12-03-2015 This Appeal is preferred against the order dated 12.11.2014 passed by the court of learned Sessions Judge, Jehanabad in U.A. P. Case No.01 of 2014.

Heard learned counsel for the appellant and the learned Additional Public Prosecutor.

The appellant is being tried as an accused in Kurtha P.S. Case No.96 of 2014. The crime was registered in respect of setting on fire a JCB machine. In the FIR, no person was named, but three were put to trial later. Out of them, two accused, by name Mahesh Prasad @ Ajit Kumar, son of Ram Das Prasad, and Shanker Saw, son of Dwarika Saw, filed an application for bail, but the same was rejected by the trial Court. Thereafter,

Patna High Court CR. APP (DB) No.146 of 2015 (3) dt.12-03-2015 2/2 they filed Criminal Appeal (DB) 145 of 2015 before this Court. Though order dated 10.03.2015, we allowed the appeal and granted bail subject to certain conditions.

The appellant herein stands on the same footing. Learned Additional Public Prosecutor is not able to point out any distinguishing factors.

Hence, the appeal is allowed and the appellant is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jehanabad in connection with Unlawful Activities (Prevention) Act Case No.1 of 2014 arising out of Kurtha P.S. Case No.96 of 2014, and subject to further condition that he shall report to the Kurtha Police Station on every 1st and 3rd Saturdays of the month between 10 AM and 11 AM. If he fails to report for two consecutive occasions, the bail shall stand cancelled and he shall be liable to arrest.
