JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-08-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 969 of 2017, disclosing offences under Sections 341, 323, 352 and 354 of the Indian Penal Code. Allegation as per complaint petition is that the petitioner along with one co-accused entered inside the house of the complainant and tried to outrage her modesty and also tried to strangulate her.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and in fact, the petitioner is a journalist and had written several articles against the husband of the complainant and further this case is counter blast to a case lodged by the petitioner against the husband of the
Patna High Court CR. MISC. No.10599 of 2019(3) dt.06-08-2019 2/2 complainant for committing rape on the niece of the petitioner and due to which, the present false case has been filed. It has also been submitted that the petitioner is respectable person aged about 65 years and it is quite absurd from him to commit such an offence. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, let petitioner, above named, surrender in the court below on 14.08.2019, on which, the court below shall release the petitioner on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Complaint Case No. 969 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
It is further subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the trial court, except on showing some genuine reasons, failing which, the prosecution will be at liberty to move for cancellation of his bail bonds.
