The petitioner is languishing in custody since 07.09.2014 in a case registered for the offences punishable under Sections 385, 387, 504 and 506 of the Indian Penal Code. It is alleged that extortion demand of Rs.
Five Crores was made from Ex-M.P. and life threatening was given.
Patna High Court Cr.Misc. No.52099 of 2014 (04) dt.04-05-2015 2/3 During investigation it transpired that the mobile through which extortion demand was made was initially found registered in he name of Ranjan Ram, but subsequently it was stolen away by co-accused Alif Raja, who was in love with Indu Kumari, the niece of the petitioner. The relationship of the niece of the petitioner with Alif Raja was not liked by the petitioner. Alif Raja gave the alleged mobile to her beloved Indu Kumari which was misused by the petitioner for demanding extortion to implicate Alif Raja.
It is submitted by learned counsel for the petitioner that neither mobile was registered in the name of the petitioner nor there is anything on record that it was used by the petitioner rather the evidence collected during investigation suggests that mobile was stolen by Alif Raja who kept the same in his own use.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the investigation has already concluded and the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief
