JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information with accusation that he along with all other F.I.R named accused assaulted the deceased and in that course, he assaulted the injured Indal Yadav by means of rod causing injury on his head. The post mortem report of the deceased reveals that only two lacerated wounds were found on the person of the deceased whereas it is alleged that altogether eleven persons assaulted the deceased. So far as, injured Indal Yadav is concerned, the submission on behalf of the petitioner is that no injury report of Indal Yadav was brought on the case diary by the investigating officer. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S.Case No. 51 of 2015.
