The petitioner seeks bail in anticipation of his arrest in connection with Mithanpura P.S. Case No. 260 of 2019, dated 15.11.2019, instituted for the offences under Sections 414 and 34 of the Indian Penal Code and Sections 30(a), 32(II), 38(II) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

4500 litres of liquor is said to have recovered from a truck which was found to be parked in the premises of Thakur Sales and Food Beverage Industries, Mithanpura.

Patna High Court CR. MISC. No.7605 of 2020(2) dt.10-06-2020 2/2 Two persons were arrested from the aforesaid vehicle, viz., Kundan Kumar and Ravi Kumar, who are said to have disclosed the name of the petitioner.

It has been urged on behalf of the petitioner that nothing has been recovered from his possession and he is a person of clean antecedent.

Considering the facts aforestated, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Muzaffarpur in connection with Mithanpura P.S. Case No. 260 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
