The petitioner seeks bail in connection with Runni Saidpur P. S. Case No. 95 of 2014 registered under Section 25(1-B)(a), 26 and 35 of the Arms Act. The prayer for bail of the petitioner was earlier rejected by this Court, vide order dated 03.03.2015, passed in Cr. Misc. No. 51571 of 2014 with following observations:- "Since the petitioner is in custody, learned Chief Judicial Magistrate, Sitamarhi is directed to hold the trial on day-to-day basis and conclude the same as early as possible, preferably within six months from the date of receipt/production of a copy of this order, failing which the petitioner
Patna High Court Cr.Misc. No.53515 of 2015 (2) dt.09-12-2015 2/2 would be at liberty to renew his prayer for bail." It is contended that though the petitioner is in custody since 15th March, 2014, but till date no witness has been examined during trial.
Regard being had to the observations made in the aforesaid order dated 3rd March, 2015 and the period spent in the custody, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Runni Saidpur P.S. Case No. 95 of 2014.
