The petitioner apprehends her arrest in a case registered for the offence under Sections 409, 419, 420, 34 of the Indian Penal Code.
This petitioner alongwith other co-accused persons misappropriated the fund under the Nal Jal Yojna. They got only half of the said scheme executed and thereafter, left the work incomplete. It is submitted on behalf of petitioner that after investigation, the B.D.O., Saraiya, District - Muzaffarpur has issued a letter, vide letter no. 1612 dated 16.10.2021, on the basis of a joint inquiry report dated 16.10.2021 (Annexure 6) submitted by Block Panchayat Raj Padadhikari, Saraiya and incharge Statistics Officer, Saraiya regarding completion of work in question under the aforesaid scheme. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the prayer for
Patna High Court CR. MISC. No.9291 of 2022(2) dt.04-08-2022 2/2 anticipatory bail.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl.C.J.M. IV, west Muzaffarpur in connection with Saraiya P.S. Case No. 858 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
