Petitioners are in jail custody since 27.8.2014 in a case registered under sections 302, 201/34 of the Indian Penal Code Admittedly, none has seen the actual killing of deceased but in course of investigation, one witness claimed that prior to alleged occurrence petitioners and other accused along with the deceased had taken wine in her house and apart from the aforesaid circumstance, it is alleged that petitioner no.1 used mobile of the deceased after putting another sim after alleged occurrence and except the aforesaid material, there is nothing against the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above stated petitioners be released

Patna High Court Cr.Misc. No.50363 of 2014 (3) dt.31-03-2015 on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Smt. Sulekha Jha, Judicial Magistrate, Ist Class, Munger/concerned court in Dharhara P.S. Case no. 194/2013.
