Petitioner is accused in connection with Rosera P.S. Case No. 343 of 2014 registered under Sections 399, 402 of the I.P.C. and 25(1-b)a, 26, 35 of the Arms Act.

The Police on receiving secret information about making the plan of committing offence by miscreants reached at orchard and apprehended three persons namely Ram Babu Paswan, Sanjeet Kumar Mahto and Lal Vijay Choudhary armed with pistols and mobile set and they also disclosed the name of two others as Sudhir Paswan and this petitioner, who succeeded to flee away.

Patna High Court Cr.Misc. No.50722 of 2015 (2) dt.04-02-2016 2/2 petitioner submits that petitioner has not been arrested on the spot rather co-accused has disclosed the name of petitioner. It is also submitted that petitioner has voluntarily surrender on 19.02.2015 and since then he is in custody, have no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge, Rosera, Samastipur in connection with Sessions Trial No. 415 of 2015 arising out of Rosera P.S. Case No. 343 of 2014. Out of two sureties, one surety must be parents or close relatives of the petitioner. (Rajendra Kumar Mishra, J.) Shail/- U T
