JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 This is an application for grant of anticipatory bail in connection with Kumarkhand P.S. Case No. 124 of 2018, disclosing offences under Sections 409, 420, 120(B), 34 of the Indian Penal Code.

Allegation against the petitioner, who is a Gramin Awas Sahayak, is that he along with other accused persons have given the benefit of Indira Aawas Yojna twice to the beneficiaries and committed irregularities.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and his work is only to prepare the list and accordingly give the same to the beneficiaries and lastly the B.D.O. does prepare the same and the petitioner has no role in

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura, in connection with Kumarkhand P.S.
