While the informant along with his brother, deceased Upendra along with nephew Ajay Yadav and Vijay Yadav, Bhaso Yadav, Krishna Yadav were going and as soon as reached near Samudayik Bhawan, they found Vinay Paswan and others having variously armed out of whom Sri Kishore Paswan and Krishna Nand Bharti ordered to apprehend deceased Upendra Yadav over which they ran however, were chased by all the accused who apprehended Upendra and then thereafter, Vinay Paswan pierced Gupti in his stomach while Pappu Paswan gave Farsa blow. Then thereafter, remaining also assaulted. It has also been disclosed that when they tried to intervene, they were chased by Ajay Paswan, Surendra Paswan, Khakharu Paswan, Baban Paswan, Bhedi Paswan who were armed with pistol by way of indiscriminate firing.
After going through the case diary, it is apparent that petitioner carried similar status and that being so, could not be identified to be the assailant of the deceased.
Patna High Court Cr.Misc. No.51290 of 2014 (3) dt.06-04-2015 Accordingly, petitioner Ajay Paswan is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No.117 of 2012.
