The petitioner seeks regular bail in connection with Darihat P.S. Case No. 16 of 2017 for the offences punishable under Sections 302, 201, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding the dead body of the father of the informant having been found lying in the field and it is suspicion of the informant that the accused persons including the petitioner had done away with the father of the informant. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case inasmuch as he has not even been named in the FIR. It is further submitted that the persons, who have been named in the FIR,

Patna High Court CR. MISC. No.11321 of 2019(2) dt.25-02-2019 2/2 have already been enlarged on bail, one of such orders is dated 15.12.2018 passed in Cr. Misc. No. 57978 of 2017. The petitioner is having a clean antecedent and is languishing in custody since 26.11.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned JN- 1st, Dehri-on-Sone, Rohtas in connection with Darihat P.S. Case No. 16 of 2017.
