The petitioner is accused in connection with Sessions Trial No. 216 of 2007 arising out of Bettiah Town P.S. Case No. 74 of 2006 registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that prayer for bail of the petitioner was rejected thrice by a Bench of this Court and he is in custody since 8th of April 2010. It is further submitted that till today out of seven charge sheeted witnesses only two witnesses have been examined, namely, Ram Kumar Singh and Nitesh Kumar Singh and since 24.04.2014 no any
Patna High Court Cr.Misc. No.51557 of 2014 (2) dt.08-04-2015 witness has been examined in this case and at present the case is pending in the court of Additional District and Sessions Judge-II, Bettiah, West Champaran.
Having considered the facts and circumstances of the case, I find no ground to reconsider the prayer for bail of the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. However, the trial court is directed to conclude the trial of the petitioner by taking all effective steps. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
