The petitioner seeks regular bail in connection with Barachatti P.S. Case No. 775 of 2018 registered for the offence punishable under Section 30(a), 38 and 47 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 108 litres of illicit liquor from one Innova vehicle.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and in fact the said Innova vehicle does not belong to the petitioner herein. It is further submitted that the petitioner is accused in two other cases, however, he is on bail in the said two cases. Lastly, it is submitted that the petitioner is languishing in

Patna High Court Cr.Misc. No.8975 of 2019(2) dt.15-02-2019 2/2 custody since 20.12.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Gaya in connection with Barachatti P.S. Case No. 775 of 2018.
