The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 32(ii) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 2836.8 litres of IMFL is stated to have been recovered from the vehicle being driven by this petitioner.
It is submitted by learned senior counsel appearing for the petitioner that no incriminating article has been recovered from the possession or vehicle of the petitioner. He has been falsely implicated in the case. He has no criminal antecedent under the Bihar Prohibition and Excise Act, 2016. He is in custody since 29.12.2020. Charge sheet has been

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody since 29.12.2020, the Court directs the petitioner to be enlarged on bail in connection with Lakhisarai P.S. Case no. 655 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge (Excise), Lakhisarai.
