This application for regular bail arises out of Chanan P.S. Case No. 119 of 2019, GR No. 1686 of 2019, disclosing offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner, at the very outset, has drawn the Court's attention to an order of this Court dated 27.02.2020, passed in Cr. Misc. No. 86100 of 2019 whereby coaccused Nuneshwar Manjhi has been allowed regular bail by this Court. The records of the said case are available before this Court.

On perusal of the case diary, which is available in records of Cr. Misc. No. 86100 of 2019, I am, prima facie,

Patna High Court CR. MISC. No.7412 of 2020(4) dt.02-06-2020 2/2 satisfied with the submission made on behalf of the petitioner that the petitioner's case is identical with the case of co-accused Nuneshwar Manjhi.

Learned Additional Public Prosecutor has not been able to point out any fact which can be said to be distinguishing the petitioner's case from that of Nuneshwar Manjhi for the purpose of consideration of his application for bail. Considering the facts and circumstances, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Lakhisarai, in Chanan P.S. Case No. 119 of 2019, GR No. 1686 of 2019.
