JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 10.09.2014 in a case registered under Sections 376,420 and 406 of the Indian Penal Code.

According to prosecution case itself, the informant being major lady decided to elope with the petitioner and after elopement of the informant her mother lodged Chapra Town P.S.Case No. 57 of 2011 against the petitioner and his father. The accusation against the petitioner is that he established physical relation with the informant on false promise of maintenance but later on, he refused to provide maintenance to the informant and thereafter in the year 2013 the informant lodged the present case.

No.51796 of 2014 (2) dt.05-01-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Chapra in connection with Chapra Town P.S .Case No.183 of 2013.
