JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-12-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 498A, 306 and 504 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The prosecution case is that the daughter of the informant committed suicide, as her dead body was recovered from railway track, due to torture inflicted by the accused persons including the petitioner for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that the victim of her own committed suicide and the informant has retracted from his initial version and filed a petition to that effect before the learned court below.

Considering the nature of accusation, this Court is not

Patna High Court Cr.Misc. No.54942 of 2015 (2) dt.03-12-2015 2/2 inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Jagdishpur P.S. Case No. 120 of 2015 pending in the court of learned CJM, Bhagalpur. Accordingly, the application is disposed of.
