This application for anticipatory bail arises out of Maker P.S. Case No. 143 of 2018, disclosing offences under Sections 341, 323, 498-A, 504 and 34 of the Indian Penal Code. The informant herself alleges in the FIR that she is a married lady and had eloped with the petitioner for marrying with him. It is also alleged that she and the petitioner got married thereafter.
In view of the nature of accusation in the FIR, in my view, a case for grant of anticipatory bail is made out. Accordingly, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender
Patna High Court Cr.Misc. No.10734 of 2019(2) dt.22-02-2019 2/2 within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned A.C.J.M. XXIIth, Saran at Chapra in Maker P.S. Case No. 143 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
