Petitioner seeks regular bail in a case registered for the offence punishable under Sections 406, 420, 467, 468 and other allied sections of the Indian Penal Code and section 3 of B.P.I.D. Act.

Allegedly, this petitioner and co-accused persons called women to take loan of Rs 50,000/- sanctioned in their names and accordingly, they persuaded said women to receive Rs 1623/- in advance and later on said accused persons misappropriated said advanced money given by group of 15 women.

The main submissions advanced by the learned counsel for the petitioner are that three persons including the

No.9164 of 2022(2) dt.23-06-2022 2/2 petitioner are stated to have been caught by the villagers in respect of commission of alleged offence in which two accused persons, namely, Ratnesh Kumar Giri and Ravi Shankar Kumar Giri have been granted bail by a coordinate bench of this court vide order passed in Cr. Misc. no. 68335 of 2021 and case of the petitioner stands on similar footing with the said co-accrued and having no antecedent as per para-3 of the petition. Learned APP opposes the prayer for bail.

In view of the above submissions and considering the petitioner's case being similar to co-accused persons who have been granted bail by a coordinate bench of this Court vide order passed in the above mentioned miscellaneous case and and as per para 3 of the petition, petitioner has got no criminal antecedent, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari in Sugauli P.S Case No. 302 of 2021.
