JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 The petitioner seeks regular bail in connection with Belhar P.S. Case No. 217 of 2019, registered for offences punishable under Sections 363/366(A) of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in her statement under Section 164 Cr.P.C., the girl has not supported the case of prosecution rather her statement discloses that she had gone out of her own sweet will and further she has not made any allegation of overt act by the petitioner. It has also been submitted that petitioner has no criminal antecedent and he has been in judicial custody since 14.11.2019.

learned counsel for the State opposed the prayer for

Patna High Court CR. MISC. No.7694 of 2020(2) dt.18-02-2020 2/2 bail on the ground that the girl is minor aged about 13 to 14 years.

Having heard both sides, considering the facts and circumstances of the case, at this stage, I am not inclined to enlarge the petitioner on bail. However, once charge is framed petitioner will be at liberty to renew his prayer for bail. This application is accordingly dismissed.
