Heard learned counsel for the petitioner.

It appears that the Probate Case No. 10/99 is pending in the court below for 22 years. A petition was filed on behalf of the petitioner, seeking permission to call for the registration No. of Scribe, who prepared the deed of will.

The learned court below has mentioned in its order itself that this is a very old case of year 1999 and the argument of the plaintiff in that case was concluded. Opposite party had also advanced their arguments. It has been mentioned in the

Patna High Court C.Misc. No.117 of 2021(2) dt.23-11-2021 2/2 impugned order that the present petition has been filed only in order to delay the disposal of the case.

I do not find any merit in the submissions of learned counsel for the petitioner.

Accordingly, this miscellaneous petition is being dismissed.

Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
