The petitioner being Panchayat Secretary is languishing in custody since 01.11.2014 in a case registered for the offences punishable under Sections 409 and 420/34 of the Indian Penal Code.

It is alleged that the FIR named accused persons were given advance of Rs.39,12,875/-and 17,61,800/- for execution of the various schemes of the Panchayat but the relevant vouchers for the same were not submitted and ultimately the petitioner could not give the account of Rs.21,00,000/-. It is submitted by learned counsel for the petitioner that the petitioner was directed by the informant to

Patna High Court Cr.Misc. No.547 of 2015 (03) dt.30-01-2015 2/2 submit the account but at the relevant time he was in custody in another case as a result he could submit the account and similarly situated Panchayat Secretary has been granted bail vide Cr. Misc. No. 2996 of 2015.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S.
