JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 This is an application for grant of anticipatory bail in connection with Barahiya P.S. Case No. 284 of 2018, disclosing offences under Section 414 of the Indian Penal Code and Sections 30(a), 38(1), 41(1) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 60 liters foreign liquor from the house of co-accused person and motorcycle of the petitioner was also seized from there and it is said that the motorcycle is a stolen property.

Submission of learned counsel for the petitioner is that he has annexed papers showing that the motorcycle belongs to the petitioner and so far other allegation of recovery of liquor is concerned, petitioner has no concern with the same. Further submission is that the petitioner is accused in one more case, but

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of six weeks from the date of receipt of the order of this Court and produce registration number of the vehicle and the court concerned shall verify the authenticity of the certificate and in the meantime, the court below shall release the petitioner on provisional bail for a period of two months to his own satisfaction and once the authenticity of certificate is proved in favour of the petitioner, the court below shall confirm the provisional bail of the petitioner otherwise, he is free to pass any order as he deems fit and proper.

With the above observation, this application is disposed of.
