The petitioner apprehends his arrest in connection with Belchhi P.S. Case No.94 of 2021, registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code.

The prosecution story is that, the informant runs consumer service center in Bank of Baroda, Belchhi. On 24.11.2021, petitioner and other co-accused persons went to his center and said that they want to invert some money in the bank. It is alleged that they snatched Rs.40,000/- from his hand and escaped.

It is fairly submitted by the learned counsel for the petitioner that Rs.40,000/- has been recovered from the house of the petitioner but there is no identification conducted by the
Patna High Court CR. MISC. No.11451 of 2023(3) dt.21-07-2023 2/2 police till date to show that the said amount belongs to the informant. Petitioner has no criminal antecedent. 5.
Learned APP for the State opposed the prayer for anticipatory bail by submitting that the bail application of one of the co-accused has been withdrawn by the learned counsel appearing on behalf of that petitioner in Cr. Misc. No.75327 of 2022 vide order dated 19.06.2023.

Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.
However, the petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek for regular bail, and the learned Court below would pass the order on the same day, in accordance with law. (Anjani Kumar Sharan, J) shikha/- U T
