JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 13.08.2014 in a case registered under Sections 307 and other minor sections of the Indian Penal Code as well as 27 of the Arms Act. The accusation against the petitioner is that he as well as others opened fire but according to prosecution case itself, it was co-accused Manoj Yadav, who caused fire arm injury to the informant.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Barh, Patna in connection with
