Petitioner apprehends his arrest in a case registered under Section 498(A) of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

Informant has alleged in her written complaint that petitioner and all other family members are torturing her for non-fulfillment of demand of Rs. 2,50,000/- in dowry and also one Apache motorcycle. Marriage was solemnized in the year 2017 and from the said wedlock one son is also born who is 1 1⁄2 years old. FIR has been instituted on 01.11.2019. It has been submitted on behalf of petitioner that prior to institution of the FIR he had filed a case for divorce against informant which is pending before the Family Court,

Patna High Court CR. MISC. No.7922 of 2020(2) dt.29-02-2020 2/2 Patna being Matrimonial Case No. 1240 of 2019 and present case has been filed in retaliation of said matrimonial divorce case.

Counsel for the opposite party has vehemently opposed the prayer for grant of bail to petitioner. Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Danapur P.S. Case No. 849 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
