The petitioner seeks bail in a case for the offences punishable under sections 302/34 of the I.P.C and section 27 of the Arms Act.

Allegedly the petitioner fired shot from his pistol causing injury on the chest of son of the informant due to which son of the informant died.

Submission at the bar for release of the petitioner is that he has been implicated due to land dispute and he is suffering in custody since 31st January, 2014.

The learned A.P.P. duly assisted by the learned

Patna High Court Cr.Misc. No.51985 of 2014 (3) dt.03-03-2015 2/2 counsel for the informant opposes prayer for bail by submitting that the petitioner is the main assailant.

In the facts and circumstances, considering that the petitioner is the main assailant, his prayer for bail is hereby refused in connection with S.T. No. 449 of 2014, arising out of Muffasil (Singhaul) P.S. Case No. 528 of 2013, G.R. No. 5743 of 2013.
