KUMAR ORAL ORDER 12-06-2020 The proceedings of the Court are being conducted through Video Conferencing and the Advocates joined the proceedings through Video Conferencing from their residence. Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in a case registered for the offence punishable under Sections 307, 302/34 of the I.P.C. and 27 of the Arms Act.

Allegation against petitioner is of firing upon the brother of informant in the stomach, as a result of which he died on the spot.

Earlier prayer for bail of the petitioner has been twice rejected by this Court vide Cr. Misc. No. 14477 of 2018 dated 06.04.2018 and vide Cr. Misc. No. 69365 of 2018 dated

Patna High Court CR. MISC. No.8164 of 2020(2) dt.12-06-2020 2/2 23.01.2019 with a direction to the trial court to conclude the trial within six months. Petitioner has no criminal antecedent and is in custody since 15.09.2017.

Considering the nature of allegation against petitioner, I am not inclined to grant bail to the petitioner at this stage. Accordingly the prayer for bail is rejected.

However, trial court is directed to expedite and conclude the trial within three months from the date of receipt/production of a copy of order passed by this Court. (S. Kumar, J) veena/rajivU T
