The petitioner, Amjad Alam, seeks regular bail in Makhdumpur P.S. Case No.215 of 2014, registered under Sections 307/414 of the Indian Penal Code and under Sections 25(1-B)a, 26(II), 27 and 35 of the Arms Act.

The informant alleged that the villagers apprehended three persons including the petitioner and handed over them to the police. It is alleged by the villagers that one of the accused opened fire and arms was also recovered by the police and the villagers.

Learned counsel for the petitioner submits that there is no material on record to show that the petitioner opened fire. Nothing has been recovered from the possession of the petitioner. The firearm was recovered from the field.

Having considered the facts and the nature of allegations made against the petitioner and the fact that no firearm was recovered from the possession of the petitioner, his prayer for bail is allowed.

The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No.215 of 2014.
