====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 21-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bhagwanpur P.S. Case No. 231 of 2021 lodged under Sections 302/ 201/ 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is a long pending dispute going on between the brothers namely Hasibur Rahman and Md. Mohiuddin his name was figured in this case only and only due to the reason that he use to do the cultivation work for Hasibur Rahman.

Learned counsel for the petitioner further submits that the criminal antecedent of the present petitioner is clean and he is in custody since 07.10.2021. It has also been mentioned that the accused Md. Azam and Hasibur Rahman were granted bail

Patna High Court CR. MISC. No.9172 of 2022(3) dt.21-07-2022 2/3 by this Court in Cr. Misc. No. 12115 of 2022 and Cr. Misc. No.8967 of 2022.

Learned counsel for the State opposes the prayer for bail and submits that in the case diary on the confessional statement of the petitioner the dead body has been recovered. Considering the facts and circumstances of this case and submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate1, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 231 of 2021, subject to the conditions as laid down under Section 437(3) of the Cr. P.C.

The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.
