JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner seeks bail in connection with Bakhri P.S. Case No. 334 of 2014 registered for the offence punishable under Sections 25(1-B)A, 26/35 of the Arms Act. Allegedly, one loaded country made gun of 12 Bore with four live cartridges were recovered from possession of the petitioner and from possession of other co-accused also arms and ammunitions were recovered.
Submission is of false implication and that the petitioner is labour and was sleeping at Bandh at night from where he was arrested, the petitioner is suffering in custody since 25.10.2014 and, as such, he deserves sympathetic consideration to
Patna High Court Cr.Misc. No.30769 of 2015 (3) dt.30-10-2015 which the learned APP opposes by submitting that the petitioner is accused in three more cases.
In the facts and circumstances stated above, considering the alleged recovery and period of detention, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Rameshwar Mishra, J. M. Ist Class, Begusarai in connection with Bakhri P.S. Case No. 334 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
