1. Heard the parties.

2. Petitioner seeks regular bail in connection with Sitamarhi P.S. Case No. 858/ 2023 dated 15.11.2023 registered for the offence(s) punishable under Section(s) 399, 402, 414 of the Indian Penal Code and under section(s)25(1AA), 25(1-B)a, 26 and 35 of the Arms Act.

3. The main submissions advanced by learned counsel for the petitioner are that as per allegation, only one mobile phone and a small knife are alleged to have been recovered from the possession of the petitioner and from possession of other accused persons, knives, loaded pistol etc. are said to have been recovered but there is no serious allegation against this petitioner and he has got no criminal antecedent and he has been languishing in jail since 15.11.2023 and against the petitioner,

Patna High Court CR. MISC. No.11785 of 2024(2) dt.28-02-2024 2/2 investigation has been completed. Further submission is that petitioner is owner of the seized mobile which is said to have been recovered from his possession.

4. Learned APP appearing for the State opposes the bail prayer.

5. In the facts and circumstances of the case and considering the above submissions and mainly taking account the petitioner's fair and clean antecedent and completion of investigation against him, this court is inclined to accept his bail prayer. Accordingly, let the petitioner named-above be released on bail in connection with Sitamarhi P.S. Case No. 858 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
