The petitioner seeks bail in anticipation of his arrest in connection with Barauli P.S. Case No. 334 of 2018 dated 24.12.2018 instituted for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Approximately 16 litres of liquor is said to have been recovered from an abandoned poultry farm, said to belong to the petitioner.

Learned counsel for the petitioner has submitted that from the prosecution report itself, it appears that the recovery has been made from a dilapidated and abandoned poultry farm. It has been submitted that because of the building having been run

Patna High Court Cr.Misc. No.10815 of 2019(2) dt.22-02-2019 2/2 down, it is accessible from all sides and petitioner has not been using it for any purpose whatsoever for last several years.

Regard being had to the aforesaid facts as also taking into account the clean antecedent of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Second Additional Sessions Judge-cum-Special Judge Excise, Gopalganj in connection with Barauli P.S. Case No. 334 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
