Earlier the prayer for bail of the petitioners was rejected by this Court, vide order dated 21.12.2018 passed in Cr. Misc. No.71537 of 2018.

The allegation against the petitioner and other accused persons is of firing on the husband of the informant and he died.

Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against any of the petitioners and they were seen fleeing away from the place of occurrence and considering the same liberty was given to the petitioners to renew their prayer for bail after

Patna High Court CR. MISC. No.9281 of 2019(4) dt.04-04-2019 2/2 framing of the charge and the charge has been framed. They are in cstody for eight months..

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sri Man Mohan Sharan Lal, Sessions Judge, Madhepura in connection with Sessions Trial No.228 of 2018 arising out of Alamnagar P.S.Case No.153 of 2018, with condition that they will cooperate in disposal of the trial and will also appear as and when required by the learned court below; otherwise their bail bond shall be cancelled.

With the aforesaid direction, this application is allowed.
