The petitioner is in custody in connection with Siswan (Chainpur O.P.) P.S. Case No. 180 of 2014 for offence punishable under Sections 341, 323, 324, 307, 447, 504 and 302/34 of the Indian Penal Code.

Mr. Ranjan Kumar Dubey, learned counsel for the petitioner with reference to the FIR submits that the occurrence is an outcome of civil dispute and the petitioner is charged of being an order giver. He submits that although there are specific allegation against the other accused of assaulting the informant and family members but no specific overt act is attributed to the petitioner who is aged about 75 years and is in custody since 22.3.2014.

No.50576 of 2015 (2) dt.10-11-2015 Having heard learned counsel for the parties and considering the nature of allegation, the age of the petitioner as also the period of custody, let the petitioner Jagdish Mahto be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Siswan (Chainpur O.P.) P.S. Case No. 180 of 2014. (Jyoti Saran, J) S.Sb/- U T
