The petitioner seeks bail in a case instituted for the offences under Section 392 of the Indian Penal Code. Prosecution case, in short, is that that while the informant was going by pick-up vehicle, accused persons took away the vehicle and fled away.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.5.2018. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R . There is no recovery of any incriminating articles from the possession of

Patna High Court CR. MISC. No.9519 of 2019(3) dt.18-04-2019 2/2 the petitioner. The petitioner has not been put on T.I.P. It is further submitted that the petitioner may be released after completion of 18 months in custody.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R..

Considering the aforesaid facts and circumstances, on completion of 18 months in custody, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Uda Kishunganj, Madhepura in connection with Alam Nagar P.S. Case No. 225 of 2017.
