Heard the learned counsel for the petitioner and learned APP for the State as well as learned counsel for the union of India.
The petitioner apprehends his arrest for the offences alleged under Sections 8/20(b)(ii)(B)/22 of the NDPS Act, registered in connection with Jalalgarh P.S.Case No. 184 of 2021.
As per allegation, five kg of ganja was recovered by the raiding party from the house of the present petitioner.
Patna High Court CR. MISC. No.9821 of 2022(2) dt.08-09-2022 2/2 The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. He has submitted further that the quantity of ganja so recovered is upper limit of small quantity.
The FIR itself shows that at the raid of the house the petitioner and his family members were present and five kg of ganja was recovered from his house, as such, he is not entitled to anticipatory bail which is hereby rejected. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
