JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-02-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner, in the present case, is seeking a direction to S.H.O., Dahanarua Police Station, District-Patna to provide security and protection of life, limb or property of the petitioner. Learned counsel for the petitioner submits that the petitioner happens to be the daughter of the one of the co-sharers of Mahendra Gope and has got a piece of land by gift from her mother after death of her father. It is her case that her co-sharers

Patna High Court Cr. WJC No.2505 of 2017 (2) dt.08-02-2018 (cousin brothers) are creating troubles and hindrance in the matter of her possession over the said land. A copy of the order dated 13.06.2016 passed by the learned Deputy Collector Land Reforms, Masaurhi, Patna in BLDR Case No.53/2015-16, as contained in Annexure-1, has been brought on the record to show that the findings with regard to said piece of land are in favour of the present petitioner. Learned counsel submits that this order, as contained in Annexure-1, has not been interfered with or disturbed by any appellate authority till date. Attention of this Court has been drawn towards the facts stated in paragraph 9 of the application where it is stated that this petitioner has also lodged an FIR being Dhanarua P.S. Case No.281 of 2017 dated 08.06.

2017 against Ranjeet Yadav, Guddu Yadav and others. Grievance of the petitioner is that the police authorities are not providing her adequate protection as a result of which she is being harassed. On the other hand, learned counsel representing the State submits that presently he has no instruction in the matter. However, so far as grievance of the petitioner regarding her security and protection of life is concerned, the State and its authorities are always ready to take care of the grievance of a citizen if she is complaining about any threat of her life and liberty or property.

WJC No.2505 of 2017 (2) dt.08-02-2018 In the facts and circumstances of the present case, the present writ application is being disposed of with a direction to the S.H.O., Dahanarua to assess the threat perception of the petitioner and if it is found that she has got real threat of her life, liberty and property, it will be the responsibility of the officer incharge of the concerned police station within whose jurisdiction the petitioner is residing to protect the life, liberty and property of the petitioner in accordance with law.

The application stands disposed of.
