JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Dandari P.S. Case No. 54 of 2014 registered for the offence punishable under Sections 25(1-B)A, 26 of the Arms Act. Allegedly, during police patrolling the petitioner was arrested and on search one loaded country made pistol with two live cartridges of .315 bore were recovered from possession of petitioner.

Submission is that the alleged search and seizure are not in accordance with law and the petitioner is suffering in custody since 29.7.2014.

In the facts and circumstances and considering the period of detention, the petitioner above named is directed to be

No.51997 of 2014 (3) dt.03-03-2015 released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Dandari P.S. Case No. 54 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
