The petitioner is apprehending arrest in a case registered for the offences punishable under section 366A of the Indian Penal Code.

The prosecution case is of abducting the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that in 164 Cr.P.C. statement the victim got his statement recorded as 17 years whereas the court assessed her age as 18 years where she stated that she was abducted and ravished by the petitioner but has also admitted that the petitioner performed marriage with the victim and she wants to reside with

Patna High Court Cr.Misc. No.51170 of 2015 (2) dt.09-11-2015 2/2 the petitioner.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Danapur P.S. Case No. 183 of 2014 pending in the court of learned ACJM, Danapur at Patna. This application is disposed of with the aforesaid observation/direction.
