Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Khagaria (Chitragupt Nagar) P.S. Case No.957 of 2019 registered for the offence under Section 30(A) of Bihar Prohibition and Excise Act, 2018.

As per allegation in the FIR, 750 ml. Indian made foreign liquor was recovered from a bag.

Learned counsel for the petitioner submits that the petitioner has committed no offence and he has falsely been implicated in this case. He also submits that similarly situated

Patna High Court CR. MISC. No.19715 of 2021(2) dt.15-11-2021 2/2 co-accused Chhotu Thakur @ Chhotu Kumar has been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr.Misc.No.14226 of 2020 dated 13.08.2020. Petitioner is in jail custody since 06.01.2021.

However, learned APP for the State vehementally opposed the prayer for regular bail.

In the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Khagaria in connection with Khagaria (Chitragupt Nagar) P.S. Case No. 957 of 2019.
