The petitioner seeks bail in a case registered for the offence under Sections 307 & other allied sections of the Indian Penal Code.

As per the F.I.R., this petitioner assaulted the informant on his head with iron rod.

It is submitted on behalf of petitioner that though, the alleged occurrence took place on 08.04.2020, but F.I.R. has been lodged after lapse of 8 days i.e. on 16.04.2020 and there is no plausible explanation of delay. There is case and counter case and both sides sustained injuries. Petitioner is in custody since 18.11.2021.

Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 5th Addl. Chief Judicial Magistrate, Manigachhi, Darbhanga in connection with Manigachhi P.S. Case No. 88 of 2020.
