The petitioner seeks bail in connection with Salkhua Police Station Case No.125 of 2014/G.R. No.125 of 2014 registered under Sections 302 and 201/34 of the Indian Penal Code besides Section 27 of the Arms Act.
The allegation of the informant, Vijay Singh, is that on 14.06.2014, his son, Ratan Kumar, had gone to see 'Yagya' at Maa Kali Asthan, Ghamara Ghat, from where he went to the house of his cousin sister, Bulanti Devi, at village-Kabira Bind Toli, P.S. Salkhua and there he put the vermilion on the head of Champa Kumari, the sister-in-law of Bulanti Devi. Due to that reason, all
Patna High Court Cr.Misc. No.50901 of 2015 (2) dt.18-12-2015 2/2 the accused persons, named in the F.I.R., including the petitioner, on 15.06.2014 took to his son at Jhaua Bahiyar and committed his murder by firing at his temporal region and threw his dead body with a view to conceal it.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner and other accused have falsely been implicated in this case on mere suspicion. The informant is not an eye witness to the occurrence. It is further submitted that the similarly situated co-accused, Sri Gulam Singh, has already been granted bail by a coordinate Bench of this Court vide order dated 03.12.2014 passed in Criminal Misc. No.46608 of 2014. The petitioner having no criminal antecedent is in custody since 05.08.2014.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Salkhua P.S.
