The petitioners are apprehending their arrest in connection with Puraini P.S. Case No. 138 of 2018 registered for the offences under Sections 341, 323, 308, 380, 448, 354(A), 504, 506 and 34 of the Indian Penal Code.

Informant Munni Devi submitted a typed complaint before the S.H.O. of Puraini Police Station on 17.08.2018 alleging that her father-in-law Budho Pandit, mother-in-law Meena Devi, Devar Shankar Kumar Pandit, Bhola Pandit, Shiva Pandit, Mahadeo Kumar and Pujo Kumar brutally assaulted her

Patna High Court CR. MISC. No.14906 of 2019(2) dt.12-03-2019 2/3 and made her half necked. Her husband came after some time and brought her to Primary Health Center, Puraini from where she was referred to Madhepura. It is further alleged that when she returned to her house she found Rs. 50,000/- of group, three Bhar gold ornament and silver ornament of Rs. 10,000/- along with utensils were taken away. When her brother Anand Pandit came to pacify the matter he was also assaulted and his mobile of Rs. 50,000/- a golden chain worth Rs. 32,000/- were snatched.

Learned counsel for the petitioner submitted that petitioner no. 1 is the father-in-law, petitioner no. 2 is the mother-in-law and petitioner no. 3 is the Devar of the informant. It is submitted that no any document relating to treatment of the informant has been annexed with the first information report at the time of lodging the FIR. It is further submitted that no such alleged occurrence have ever taken place.

Considering the facts and circumstances of the case, relationship of these petitioners and the submissions that no document relating to treatment of the informant could be brought to the notice of the court below, let the petitioners above named, in case of their arrest or surrender within a period of four weeks from today in connection with Puraini P.S. Case No.

Patna High Court CR. MISC. No.14906 of 2019(2) dt.12-03-2019 3/3 138 of 2018, be enlarged on bail on furnishing of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
