The petitioner apprehends his arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner along with other FIR named accused persons on the point of pistol snatched cash of Rs. 30,000/- from the cash counter of the informant. It is further alleged that petitioner along with other accused persons made indiscriminate firing, as a result of which three persons sustained firearm injury.

It is submitted that from bare perusal of the FIR it is apparent that this petitioner along with other accused persons

Patna High Court CR. MISC. No.9750 of 2022(3) dt.15-09-2022 2/2 are alleged to have fired, but no one sustained firearm injury. As a matter of fact, petitioner had gone to purchase wire and in the meantime, the alleged occurrence took place. There is no specific allegation of demand of extortion against petitioner. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar (Aurangabad) in connection with Daudnagar P.S. Case No. 486 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
