JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 29-11-2017 Inter alia contending that in a public road under the jurisdiction of Zila Parishad, Nawada, a shopping complex is being constructed, which is not permissible, this Public Interest Litigation has been filed.

Keeping in view the grievance of the petitioner, we direct the respondent nos. 2 and 3 to look into the grievance of the petitioner and in case it is found that on a public road constructions are being made, contrary to the requirement of law, the respondent nos. 2 and 3 shall intervene into the matter and issue necessary directions to Zila Parishad, Nawada with regard to the issue in

Patna High Court CWJC No.17442 of 2017 dt.29-11-2017 2/2 question. The authorities of the Zila Parishad, Nawada is also directed to look into the matter and take action within a period of one month from the date of receipt/production of a copy of certified copy of this order. Needless to emphasize that the petitioner has still any grievance, he may take recourse of remedy available in accordance with law.

With the aforesaid observations and directions, this application stands disposed of.
